General Terms and Conditions of Business
1. conclusion of the agreement
With your order you make a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by e-mail or by delivering the ordered goods. First you will receive a confirmation of receipt of your order by e-mail to the e-mail address you have provided (order confirmation). However, a sales contract is only concluded when our order confirmation is sent to you by e-mail or when the ordered goods are delivered. When ordering via our online shop, the ordering process comprises a total of six steps. In the first step you select the desired goods. In the second step you enter your customer data including invoice address and, if necessary, a different delivery address. In the third step you choose how you would like to pay. In the last step you have the possibility to check all details (e.g. name, address, method of payment, ordered articles) once again and to correct them if necessary before you send us your order by clicking on 'yes, order'.
2. storage of the contract text
We save the text of the contract of your order. You can print it out before sending your order to us by clicking on "Print file" in the last step of the order. We will also send you an order confirmation as well as an order confirmation with all order data to the e-mail address you have provided.
3. reservation of proprietary rights
The delivered goods remain our property until all claims have been paid in full.
4. prices, shipping costs, return costs in case of revocation
All prices are final prices, they contain the legal value added tax. The shipping costs are listed under "Delivery and shipping costs". As far as you make use of an existing right of revocation, you have to bear the regular costs of the return shipment, if the delivered goods correspond to the ordered goods or if you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise the return shipment is free of charge for you.
5. terms of delivery
Unless otherwise stated in the offer, we will ship the goods within 3 working days after receipt of payment.
6. terms of payment
Payment is made in advance by bank transfer or by credit card. We reserve the right to exclude individual payment methods. If you choose the prepayment method, we will provide you with the bank details in the order confirmation and the link for payment by credit card. The invoice amount must be transferred to our account within 10 days. You can only exercise a right of retention if the claims result from the same contractual relationship.
7. warranty
The warranty is based on the statutory provisions. If used goods are subject of the sales contract and the buyer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period for the purchase of used goods is one year.
8. applicable law and place of jurisdiction
Italian law applies exclusively. In relation to a consumer, this choice of law only applies insofar as it does not restrict any mandatory legal provisions of the state in which the consumer has his residence or habitual abode. Insofar as the customer is not a consumer, Bozen/Bruneck is agreed as the place of jurisdiction.
